Terms of Service

These Terms of Service ("Terms") govern your use of dmvwebflow.com (the "Site") and any services provided by DMV WebFlow ("we," "us," or "our"). By using the Site or purchasing our services, you agree to these Terms.

1. Services

DMV WebFlow offers website design, AI chatbot development, and ongoing support services for local businesses in Washington D.C., Maryland, and Virginia. Specific service deliverables, pricing, and timelines are governed by the separate Service Agreement signed at the start of each engagement, which takes precedence over these general Terms.

Because payment is collected only after delivery and approval, refunds are generally not issued once the client has approved the work and paid. If a client is dissatisfied before approval, up to 2 rounds of revisions are included at no extra cost. Full refund policy details are in the Service Agreement.

5. Intellectual property

Upon receipt of full payment, the client owns the website content and design we deliver. DMV WebFlow retains the right to display the completed work in its portfolio. Stock photography, third-party plugins, and licensed assets remain the property of their respective owners. The DMV WebFlow name, logo, and website code (excluding deliverables) remain our property.

6. Third-party services

Our services rely on third-party platforms (Cloudflare, Stripe, Groq, Web3Forms, and others). We are not responsible for outages, data losses, or changes in pricing or features of these third parties. Your use of any third-party service is subject to that provider's terms.

7. AI chatbot disclaimer

AI-generated responses may occasionally be inaccurate, incomplete, or unexpected. Chatbots deployed on client sites are tools to assist customers and are not a substitute for professional advice (legal, medical, financial, or otherwise). Clients are responsible for reviewing chatbot configurations and monitoring chatbot outputs on their own websites.

8. Limitation of liability

To the maximum extent permitted by law, DMV WebFlow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold DMV WebFlow harmless from any claims or damages arising from your violation of these Terms or your misuse of our services.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes will first be attempted to be resolved informally by contacting sam@dmvwebflow.com. Unresolved disputes shall be brought in the courts of Virginia.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
